Welcome to reDream.ai, a product offered by Sendy Software LLC, a California-based company. These Terms of Service have been established to ensure a fair and consistent user experience.
  1. Definitions: In these Terms of Service, "Company," "we," "our," or "us" refer to Sendy Software LLC. "Services" encompass all products created and maintained by Sendy Software LLC, including reDream.ai, accessible through various platforms such as web browsers, desktop applications, mobile applications, and others. "You" or "your" pertains to individuals or organizations that hold an account with any of our Services.
  2. Agreement to Terms: By using our Services, both now and in the future, you acknowledge and agree to be bound by the most recent version of these Terms of Service. This applies to all existing and future products and features within our Services. We reserve the right to exercise or enforce our rights and provisions as outlined in these Terms of Service, without implying a waiver of such rights or provisions. It is important to note that these terms contain a limitation of our liability.
  3. Account Termination: Failure to comply with any of the terms may result in the termination of your account. We understand that this necessitates placing a significant level of trust in us.

Eligibility

  1. Age Requirement: You must be at least 18 years of age to create an account on reDream.ai and use the service.
  2. Legal Authority: You affirm that you are not barred by any legal authorities in the United States from using the service. If you are accessing or using the service on behalf of an organization, you further represent and warrant that you have the legal authority to bind that organization to these terms and conditions.
  3. Use of Latest Version: You agree to access and use the most recent version of the website or app provided by us. It is your responsibility to ensure that you have the latest version installed to access the full functionality of the service.
  4. Single Account: You agree not to create or use multiple accounts on the service. Each user is allowed only one account unless expressly permitted by us in writing.
  5. Previous Account Removal: You agree not to create a new account if you have been previously removed from the service by us, unless you have obtained explicit permission from us to do so.

Account Terms

  1. Account Security: It is your sole responsibility to ensure the security of your account and password. The Company cannot and will not be held liable for any loss or damage resulting from your failure to comply with this security obligation.
  2. Use Restrictions: You are prohibited from using the Services for any purpose that is outlined (but not limited to) below:
    • Violence and Threats: You may not use redream.ai products to plan, commit, or threaten any activity that qualifies as a violent crime under applicable US laws, including federal, state, and local regulations.
    • Child Exploitation and Abuse: Activities that involve child exploitation, sexualization, or abuse are strictly prohibited on redream.ai. We have a zero-tolerance policy for such actions.
    • Hate Speech: Advocating for the extermination, domination, or oppression of individuals or groups, as well as exploiting or harming minors in any way, is not allowed on our products.
    • Harassment: Intimidating or targeting individuals or groups through repeated communication, including the use of racial slurs or dehumanizing language, is not welcome on redream.ai.
    • Doxing: Sharing other people's private personal information for the purpose of harassment using redream.ai products is strictly prohibited.
    • Malware or Spyware: Using our products to create or distribute malware, spyware, or engage in remote user surveillance is not allowed.
    • Phishing or Fraudulent Activities: Engaging in fraudulent behavior, such as lying about your identity or affiliations to steal from, extort, or harm others, is not acceptable.
    • Cybersquatting: Purchasing a redream.ai product account in someone else's name and attempting to sell it back to them is considered cybersquatting. Such accounts will be immediately canceled.
    • Intellectual Property Infringement: You may not use redream.ai products to create or disseminate work that infringes on the intellectual property of others beyond the bounds of fair use.
    • Fake News and Defamation: Generating or spreading verifiably false information and engaging in defamation or harassment of others is not permitted on redream.ai.
    • Additionally, you agree not to use the outputs of redream.ai or any derivatives in the following cases:
      • For fully automated decision-making that adversely impacts an individual's legal rights or creates/modifies binding obligations.
      • For discriminatory or harmful purposes based on online or offline social behavior, personal characteristics, or personality traits.
      • To exploit vulnerabilities of specific groups based on age, social, physical, or mental characteristics, resulting in physical or psychological harm.
      • For discrimination against individuals or groups based on legally protected characteristics or categories.
      • To provide medical advice or interpretation of medical results.
      • To generate or disseminate information for use in justice, law enforcement, immigration, or asylum processes that predict fraudulent or criminal activities through text profiling or indiscriminate and arbitrarily-targeted use.
  3. Content and Activity Responsibility: You bear the responsibility for all content posted and activities that occur under your account. This includes content posted by others who either: (a) have access to your login credentials, or (b) possess their own logins under your account.
  4. Human Accounts Only: Only human users are allowed to register accounts. Accounts created by "bots" or any other automated methods are strictly prohibited.

Payment

  1. Certain functionalities of the Service may necessitate payment. You have the option to select monthly subscriptions. The pricing details and variations between subscription plans can be found on our website.
  2. If you choose to upgrade or downgrade your subscription plan, the new rate will take effect from the next billing cycle. Upgrading in the middle of a monthly subscription will incur charges proportional to the remaining subscription term.
  3. The prices for the Service include any applicable local taxes. Payments must be made using credit or debit cards and are processed by a third-party PCI Service Provider Level 1 certified entity. We do not access or store payment information.

Modifications to Service and Prices

  1. We retain the authority to temporarily or permanently modify or terminate any aspect of our Services, with or without prior notification.
  2. We retain the authority to adjust the pricing structure of our product. While we will make efforts to exempt current customers from these modifications, we may modify prices for existing customers, providing at least 5 days' notice via the email address on file. Additionally, we may post a notification regarding changes on our website.

Uptime, Security, and Privacy

  1. Your utilization of the Services is entirely at your own risk. We offer these Services on an "as is" and "as available" basis, without service-level agreements for most of our Services. However, we prioritize the uptime of our applications.
  2. In situations where your usage significantly exceeds the average usage of other customers, potentially affecting the performance of the Service for others, we reserve the right to temporarily disable your account. Prior to taking any action, we will contact the account owner, unless under exceptional circumstances.
  3. To ensure the protection and security of your data, we employ backups, redundancies, and encryption measures, including data transmission encryption from the public Internet.
  4. By utilizing our Services, you place your trust in us with your data. We handle your data in accordance with our Privacy Policy and solely for the intended purpose outlined therein.
  5. To operate the Services, we rely on third-party vendors and hosting partners who provide the necessary hardware, software, networking, storage, and related technology.

  1. All content posted on the Services must comply with US copyright law.
  2. We do not assert any intellectual property rights over the materials you provide to the Services. Any materials you upload remain your own.
  3. The names, appearance, and overall design of the Services are protected by copyright© and are owned by the Company. All rights are reserved. Without express written permission from the Company, you are prohibited from duplicating, copying, or reusing any portion of the HTML, CSS, JavaScript, or visual design elements. If you wish to use the Company's logo or any Service logos for promotional purposes, please contact us via email to request permission. Please note that we reserve the right to revoke this permission if you violate these Terms of Service.
  4. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any part of the Services, the use of the Services, or access to the Services without obtaining express written permission from the Company.
  5. It is strictly prohibited to modify another website to create false implications of association with the Services or the Company.

Features and Bugs

  1. While we carefully design our Services based on our expertise and customer input, we cannot ensure that our Service will fully meet your individual requirements or expectations.
  2. Prior to release, we conduct thorough testing of all features; however, it is possible for our Service to contain bugs. We monitor and prioritize reported bugs, particularly those concerning security or privacy. Please note that not all reported bugs will be addressed, and we do not guarantee a completely error-free Service.

Liability

  1. You explicitly acknowledge and agree that the Company shall not be held liable, in accordance with the law or equity, to you or any third party, for any direct, indirect, incidental, consequential, special, exemplary, punitive, or lost profit damages, including but not limited to damages for the loss of profits, goodwill, use, data, or other intangible losses (even if the Company has been advised of the possibility of such damages). These damages may arise from the following: (i) the use or inability to use the Services; (ii) the cost of procuring substitute goods and services resulting from any goods, data, information, or services purchased or obtained, or messages received or transactions entered into through or from the Services; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) or any other matter relating to this Terms of Service or the Services, including but not limited to breaches of contract, tort (including negligence, whether active or passive), or any other theory of liability.
